1. Acceptance of Terms

By creating an account, making a purchase, or otherwise accessing any part of the Obsidian Digital website or platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, together with our Privacy Policy and Refund Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must not use our platform.

2. The Platform & Services

Obsidian Digital provides an online marketplace for the sale and delivery of digital products, including but not limited to e-books, PDF documents, guides, templates, and other downloadable content (collectively, "Digital Products"). We reserve the right to modify, suspend, or discontinue any part of the platform at any time, with or without notice.

3. Account Registration

To make a purchase, you must create an account. You agree to provide accurate, current and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Obsidian Digital shall not be liable for any loss resulting from your failure to secure your account credentials.

4. License for Digital Products

Upon completing a valid purchase, Obsidian Digital grants you a non-exclusive, non-transferable, non-sublicensable, revocable, personal license to access and use the purchased Digital Product for your own personal, non-commercial purposes only. This license does not permit you to: (a) share, reproduce, or distribute the product to any third party; (b) sell, resell, or rent the product; (c) modify, adapt, translate, or create derivative works; (d) remove any copyright, trademark, or proprietary notices; (e) use the product for any commercial purpose without written consent from Obsidian Digital.

5. Intellectual Property

All content on the Obsidian Digital platform — including but not limited to e-books, text, graphics, logos, button icons, images, audio clips, data compilations, and software — is the property of Obsidian Digital or its content suppliers and is protected by applicable intellectual property laws. The compilation of all content on this site is the exclusive property of Obsidian Digital. Unauthorized use of any material on this platform may violate copyright, trademark, and other laws.

6. Prohibited Conduct

You agree not to: (a) use the platform for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the platform; (c) interfere with or disrupt the integrity or performance of the platform; (d) upload or transmit viruses or malicious code; (e) engage in any form of automated data collection (scraping, crawling) without our express consent; (f) impersonate any person or entity; (g) engage in any form of piracy, unauthorized copying, or distribution of our Digital Products; (h) file fraudulent chargebacks or payment disputes.

7. Payment & Pricing

All prices are displayed in Indian Rupees (INR) unless otherwise stated, and include applicable taxes. Payments are processed securely through Razorpay. Obsidian Digital does not store your payment card information. Prices are subject to change without notice. Once a payment is confirmed, it is subject to our Refund Policy.

8. Disclaimer of Warranties

The platform and all Digital Products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Obsidian Digital does not warrant that the platform will be error-free, uninterrupted, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Obsidian Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — resulting from your access to or use of (or inability to access or use) the platform or Digital Products, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim shall not exceed the amount you paid for the specific Digital Product that is the subject of the claim.

10. Indemnification

You agree to defend, indemnify and hold harmless Obsidian Digital, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the platform.

11. Termination

We reserve the right to suspend or permanently terminate your account at any time, for any reason, including but not limited to breach of these Terms, fraudulent activity, abusive conduct toward our team, or any activity that we reasonably believe may harm the platform or other users. Upon termination, your license to all Digital Products is immediately revoked.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be resolved first through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, in India. The language of arbitration shall be English.

13. Modifications to Terms

Obsidian Digital reserves the right to update these Terms at any time. We will indicate the effective date at the top of this page. Your continued use of the platform after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
